The path to DCMC rule adoption

California has very specific policies that an association must follow before they can adopt a new operating rule or make changes to a previously adopted rule. These state guidelines ensure that all members have the opportunity to review and comment on proposed rules before they are adopted by the board and become enforceable.

Operating rules

What is an operating rule, you ask? Operating rules are broadly defined as any rule or regulation that applies to the management and operation of the association. For example, DCMC’s Island Camp Facility Policy, Assessment Collection Policy, Pump-Out Use Policy, and Vehicle Gate Access Policy have all gone through this adoption process.

Steps for adopting a rule

Here are the steps the DCMC Board of Directors follows when looking to adopt a new operating rule:

Preparation

The operating rule is prepared or amended, either by the Board (with legal counsel review) or by legal counsel.

Review

The Board reviews the proposed operating rule during an open meeting, then approves to send it to members for comment.

Notice

The Board gives general notice to members by posting the proposed rule notice to the announcement board at Island Camp. As a courtesy, your Community Life team also posts the full proposed rule to the resident website and alerts members via email. Comment

Members can submit written comments to the Board for at least 28 days via the submit a comment form on the resident website.

Vote

At an open meeting, the Board considers all comments and votes to adopt the proposed operating rule or not to adopt it.

Adoption

The Board gives notice of adoption within 15 days and posts the adopted operating rule to the governing documents page.
